Terms and conditions

1. Under the Law of Obligations Act of the Republic of Estonia, the seller is liable for any lack of conformity of a thing which becomes apparent within two years as of the date of delivery of the thing to the purchaser. It is presumed that any lack of conformity which becomes apparent within six months as of the date of delivery of a thing to the purchaser already existed before the delivery of the thing, unless such presumption is contrary to the nature of the thing or the deficiency.
2. The consumer has the right to file claims to SiberGold regarding a defective item within a period of 2 years as of transfer of the goods. The claim should be filed immediately, however, not later than within 2 months after the deficiency of the goods has been discovered! After discovering the deficiency, the consumer shall take reasonable measures to preserve and protect the item, incl. refrain from using the defective item if its use will further deteriorate its condition.
3. Upon filing a claim, the seller will always reimburse the buyer for the costs related to the repair or replacement of the goods, primarily the transport, post, work and material costs, within the first six months as of delivery of the goods to the buyer. For the following 1.5 years, the seller shall reimburse such costs only in case the claim is substantiated.
4. SiberGold shall not be liable if the item has been damaged due to the buyer’s fault or negligence; for the faults that have been caused as a result of the use of the item in the way contrary to its intended purpose or as a result of natural physical wear and tear due to normal use.
5. In case the seller and the consumer fail to reach a mutual agreement, the consumer has the right to address a competent supervisory authority, which is Latvian Consumer Protection Board. The competence of the Consumer Disputes Committee includes resolution of disputes arising from a contract made between a consumer and a contractor, which the parties have failed to resolve by mutual agreement. The consumer may also use the Internet-based dispute resolution environment of the European Union ODR (Online Dispute Resolution), which can be accessed here http://ec.europa.eu/odr
